The Las Vegas Police Department is saddened to report that a bicyclist who was involved in a traffic accident back in October of 2023 has passed away as a result of the incident. While the victim, 52-year-old Emory Garry, passed away back on October 28th, the police department is just now reporting the death after wrapping up a months-long investigation.
According to reports, the Metropolitan Police believe that Garry had been riding his mountain bike back in October at around 7:00 P.M. He was riding from west to east across Sloan Lane at Whispering Pines Avenue.
Police think that Garry was riding outside of a marked crosswalk when he made a sudden and unexpected turn. When he did, he got into the pathway of a 2013 Hyundai Elantra that was heading north.
Police believe that the driver attempted to immediately slam on the brakes and swerve the vehicle to avoid the bicyclist. Unfortunately, they didn’t have enough time to make a correction that would prevent a crash.
The driver of the Hyundai unfortunately slammed into the bicyclist. The driver, a 30-year-old Las Vegas resident, acted responsibly by stopping the vehicle, checking on the biker, and calling the police. Once the authorities arrived, Garry was severely injured. He was rushed to UMC with life-threatening wounds. Authorities who stayed at the scene of the accident checked the driver for signs of impairment, but there were none. Investigators have not explained further why or how the accident could’ve occurred.
Unfortunately, this recent accident brought 2023’s traffic fatality rate in the Metro area up to 158.
Do Loved Ones Have Recourse After a Fatal Bicycling Accident?
Do you have a loved one who enjoys bicycling in the city? If so, then it’s paramount that your loved one obeys all the traffic rules of the road to ensure their safety. Just like motorists, bicyclists are expected to obey traffic signals, follow the flow of traffic, and do their best to avoid a crash.
If an accident does happen and the impact leads to a fatality, then a lengthy investigation will ensue, as was the case in the incident above. The investigation is important for several reasons.
For one, it helps uncover what exactly happened in the accident. This information can help the loved ones of a fatally injured biker determine who might be liable for the losses associated with the crash. It can also help authorities and the community identify potential hazards and reduce them to help create a safer community for everyone.
If a bicyclist is fatally injured in an accident that’s determined to be someone else’s fault, then the loved ones can file for financial compensation for the losses they experience due to the incident. These losses might come in the form of burial costs, funeral expenses, medical bills prior to your loved one’s passing, a loss of financial support, and more. You can seek this compensation by filing a wrongful death claim against the party who caused the accident.
