Nevada State Police are sad to report that several individuals were fatally injured after getting into a collision in the early hours of November 12th. Investigators believe that a white pickup truck carrying several people was traveling northbound on Route 95. At around 5:50 in the morning, the truck reportedly veered into a lane with oncoming traffic for “unknown reasons”.
A silver pickup truck traveling southbound saw the white truck coming and attempted to avoid a crash by swerving right. Despite that, the front tire still struck the front of the white truck. Both vehicles wound up off the road and on the shoulder, but the white truck caught on fire.
All four individuals in the white truck including a 53-year-old, 38-year-old, and two minor females, were declared deceased at the scene. Five individuals traveling in the other truck were injured and taken to a nearby hospital.
Is Legal Recourse Possible after an Untimely Death?
In short, yes; you will have legal recourse if the person who caused the accident had a legal duty to provide for your loved one’s care. You won’t be able to seek out a claim, however, if the person who caused or contributed to the accident was not under any legal obligation to provide for the care of your loved one.
So, how can you tell if a legal duty of care existed in your loved one’s situation or not? To be sure, it might make the most sense to consult with an attorney, but there are some circumstances in which a legal duty of care is established automatically. For instance, every time you get behind the wheel of a vehicle, you are automatically assuming a legal duty of care towards all other motorists and pedestrians. Similarly, if you invite anyone over to your home, then you’re under an obligation to provide for their care while they’re at your residence.
If a legal duty of care exists and you can prove that the other person failed to uphold that duty of care, then you’ll be eligible to receive compensation in the form of funeral expenses, medical expenses prior to your loved one’s passing, a loss of spousal support, and more.
Have You Recently Lost a Loved One in an Accident?
Sadly, car crashes aren’t the only type of accidents that can lead to a wrongful death situation. Other types of accidents that could lead to a wrongful death claim include situations like medical malpractice, a slip and fall, an incident at work, or an injury that stems from a product purchased at a store.
If you’ve recently lost a loved one in an accident, then it’s in your best interests to research your options. Depending on the situation, you may have legal recourse.
Talking to a wrongful death lawyer can help you make an informed decision on how you should proceed. If you’re currently in the Nevada area, then you can rely on our attorneys to give you the most reliable legal information available.
