Back on March 27, 2021, the manager of the Fort Amargosa RV Park near U.S. Highway 95 called the authorities on a man who was loitering in the area. On the phone, the manager alleged the suspect had started a fight with another person in the area before a gunshot was fired.
Authorities quickly arrived and found the suspect sitting outside of his truck smoking fentanyl. The suspect reportedly told authorities that he was driving from Arizona to Oregon. The police asked the suspect if they could search his vehicle, but he declined. The authorities then reviewed surveillance video of the alleged incident. They discovered that the “gun” seen by the manager was likely just a cellphone. The “gunshot” he heard was likely fireworks.
Again, officers asked to search the suspect’s car. They told him they did not care if there were illegal drugs and only wanted to see if there was a weapon. Officers still searched the suspect’s car, but they did not find a weapon. Instead, they did find pills and burnt up tin foil. The foil was likely used to smoke fentanyl.
At the scene, authorities decided not to arrest the suspect.
One hour later, the suspect caused a devastating crash that killed three people. One of those individuals was a 12-year-old child. Two other young children also suffered injurie.
Who Could Get Held Liable for This Accident in Court?
Initial reports say that the suspect was traveling at over 90 mph when they caused the devastating crash. While the suspect is clearly responsible for the collision, he’s also alleging that the original officers who stopped him should have never allowed him to leave the scene. As a result of their negligence, the suspect says the police should bear some responsibility for this crash.
After all, the suspect was smoking fentanyl at the scene when authorities pulled up. Further, they discovered illegal drugs in his car. Even worse, body cam footage shows that the officers believed he was under the influence due to his pinpoint eyes at the scene. Despite all those findings, they still allowed the suspect to drive off.
If a future wrongful death claim emerges, it makes sense that both the suspect and the officers could get held responsible for the losses associated with the crash. As of now, the suspect has pleaded guilty to three counts of DUI causing death.
